Basically I own a rescue 501c and came into a situation I had to board some of the rescue dogs.

I placed a hold check I signed dated the check for the 31st, I did not write in an amout, and the agreement was I would make payments and at the end of the month we would have a discussion on the amount and moving forward and so forth.

In the process of the month numerous things occured the rescue had no funds and I was trying to personally pay everything out of my personal funds. I contacted them and instructed them not to put the check in it was a hold check and I make arrangements for another rescue person with a previous working relationship to make payment arrangements for me, I was dealing with so much stress I was on the verge of losing my mind. She said fine and did have a conversation with the owner about not putting the check in and she explained the situation and informed him I would need to make so kind of payment arrangements. About a week later I received a call from the check cashing store regarding a check I wrote for 2390.00 dollars I said I wrote no such check I looked at the rescue bank account and behold the owner of the boarding facility cashed the check anyhow. I called my friend that was supposed to be working on the situation and she then tells me he did respond she sent me screen shots of a text messaging conversation where she told him not to cash the check I will make payments he responded "Suli (friend helping) christina by a lot of sad that your're giving me a check tomorrow for $2390.00 and a time to deal directly with you she told that to Robert I cannot take payments I need a check tomorrow or I'm putting this check through and everyone will have to pay the fees or the court fees or the attorney fees I don't really give a s*** I need 2390 tomorrow thank you" Yes I should have been to told about this on the 30th i was not informed until over a week later when the check cashing store called me. Since then its been for weeks I've called I have gone there the owner is never there. I did finally get to him 2 sundays ago and he refused to make any arrangement with me he said to deal with his lawyer however refused to give me the info hes just holding them there every day to keep adding to the bill.

One of the dogs had a meet and greet 2 sundays ago and she was to be adopted, the owner wouldnt't answer my calls so I called the facility no response and the worker called me back I explained shes adopted and has an amazing home and I would be more then happy to give them the adoption fee. He called me back later and said if you bring 200.00 you can take her so I did. He then contacted me and told me if I can make a 500.00 payment I can pick my dogs up. I will make arrangements to pay down my entire balance. I am being told I can be criminally charged for the check and taking the dogs. I am a single mom and extremely concerned I have never been in trouble and nothing that was done was intentional I have been trying to rectify the situation and getting no where. What should I be expecting and what are my rights.

Response:

Writing a post dated check with no amount is the stupidest thing anybody can do. Once it's out there it doesn't matter what you or anybody else says. If it gets cashed you're in trouble.

It's not clear who is making all these threats.

If the check cashing place wants you to cover the check that it paid on, you'd best find the cash to cover it fast or you might just be subject to civil and criminal penalties.

If the boarding place says you need to come up with cash to cover any additional fees to get your dogs back, well, that's something you need to take up with them.

"I am a single mom"
Is that your excuse for getting into something you weren't capable of handling?

"and extremely concerned I have never been in trouble and nothing that was done was intentional I have been trying to rectify the situation and getting no where."
None of that matters.

"What should I be expecting"
That you could be sued and criminally prosecuted for the bad check although criminal prosecution is iffy.

"what are my rights."
You have many rights. Wouldn't serve any purpose to list them here as they aren't likely to apply.

Basically, you come up with the cash to cover this mess or you suffer the consequences.

If I don't appear sympathetic, just go back to my first paragraph and you'll see why.

PS: As noble as your dog rescue service is, I suggest you get out of it until you are financially capable of handling it.

Christina Barletta with No Paws Left Behind has gotten herself into trouble. She's taken on far too many dogs and needs to get them out NOW. Someone called DCF and they came and took her daughter today. Animal Control was also called and came to check on the dogs. She has until tomorrow to get 12 dogs out, and in order to get her daughter back she's going to have to get another 15 out.

4 months ago today two rescue worlds collided over this baby Heather and her 8 pups .. The story of NY Bully Crew and No Paws Left Behind began heather was part of the miami 22 dog fighting ring confiscate and Craig had a hold unknown to him heather was sick and needed emergent pull for medical his hold was preventing that lucky for us all Christina co-founder for No Paws and soon to be Florida Bully Crew called Craig to explain and release the hold and when two amazing rescues come together u get what we have now an amazing rescue partnership in which the past 4 months we have together safely in conjunction pulled responsibly 186 dogs from MDAS with 4 leaving this weekend and 4 next weekend .. We also pulled 16 dogs from Broward and pulled 5 stray dogs off the streets of Miami and Ft Meyers

She had Waffle since May 8th. She was seen by a vet prior to going to Christina. She was tested: fecal, blood, and skin scrape. She was given bordatella, dhpp, and was dewormed. NOW...Waffles has been out on a trial adoption these past 2 weeks. She had no collar, no ID tag, no microchip, no rabies, and was unaltered. Her vetting was completed yesterday and she was in heat. What garbage.

Unfortunately, I have put myself in a situation living with a hoarder. I have tried to help Christiana Barletta from No Paw Left Behind Rescue with these dogs the best I could along with my sister 24 /7. To give them a clean environment as they had been living in filth prior to us coming in.. I was hoping to get them in a healthier state of mind & condition to help get these dogs adopted that have been left NEGLECTED & UNSOCIALIZED for quite sometime before Myself and SISTER stepped in. She wont let any dogs go nor provide them medical or attention.

Cristina Barletta that owns 18 dogs here has yet been able to provide us with any health records or medical information on any of these dogs or a list of dogs in need of medicines or any sort of proof of rabies or a list of dogs taking any monthly preventive .

I will be leaving this household by choice in hopes that bringing this sad SITUATION here publicly by this post that fellow animal lovers can & could do something to end this suffering and get these dogs VETTED & OUT
We have done & tried what we possible could do to get the living conditions to a healthy state but they need medical and new owners somehow. .

We are not getting through to Cristina here to understand this is not healthy for any of her dogs sitting in cages day and night not being promoted for a better life either.

Once I leave these dogs will sadly return back to living in their own feces,unsocialized, in crates for 15 plus hrs a day again .

If you recognize any of these dogs or if these dogs belong to any rescues.

House Turned Dog Kennel. Neighbors, animal rights group and police on scene

Neighbors in the Paradise Gardens I community woke to barking dogs in an unoccupied house Saturday morning. Police were called to the scene days later by a neighbor concerned over the dogs’ health and well-being and to report a tag number of a van recently seen at the home. *Updated 3-22-2017

Eight dogs in all are apparently being kept temporarily in a vacant house while the dogs' owner is between homes. Canines were sectioned off in rooms and left throughout the day.

Neighbors said they saw no one walking the dogs, only that they were dropped off Saturday.  
Called to the scene both Monday and Tuesday, police were perplexed on how to deal with the matter.  Dogs looked and sounded healthy through the windows, which left no reason to believe that animals were abandoned or abused - and the unoccupied home had a rightful owner. Moreover, to enter the house with no probable cause or exigent circumstance could create prosecutorial problems if other illegal activities were revealed in the process. Such as whether dogs were guarding a cache of weapons or drugs.

President of animal rights group “100+ Abandoned Dogs of Everglades Florida Rescue,” Amy Roman was on scene until the caretaker arrived to explain her situation to police. The rescue group requested that the name of the caretaker remain anonymous, as personal issues caused her to seek a temporary home for canines.

“We fight for dogs that can’t fight for themselves,” Roman told MargateNews.net.


Per state statute, Roman said police could enter the home without the owner’s permission if they truly believed dogs were in distress. In this case, Roman felt police acted appropriately.

“I’m really glad they stayed here and they contacted the owner and that the owner is coming here to show them the dogs. What they’re doing first by contacting the owner before breaking the door down is the right thing to do,” she said.
While the caretaker claimed she came to feed the dogs four to five times a day, neighbor, Stacy Coker, said “no way.” Coker  has kept a keen eye on the house since Saturday watching for cars coming and going. In fact, she called 911 on MargateNews.net when we were casing the property (video at bottom).

After seeing the dogs, police told neighbors that canines appeared healthy, fed and watered.

Coker said the story has a happy ending.  She spoke with the dog owner and volunteered to help with the dogs during their temporary stay at 990 NW 67th Terrace. Coker lives just a few doors down. “All I care about is the dogs,” she said. “I don’t care about anyone’s situation. As long as the dogs are okay that’s what matters.”

MargateNews.net is currently waiting for police to confirm whether current rabies vaccines and registrations were reported, and whether dogs had dry, adequate bedding inside the house.  Also, if eight dogs barking day and night with no people living in the house would be considered a “nuisance” should neighbors in the quiet 55 and older community complain.

In response, police said the eight dogs found in the residence were under the care of a not-for-profit organization.

"The Animal Control Officer arrived on scene and verified that all the dogs were healthy and in good condition. There were no city ordinance violations observed on scene. The investigation is currently open," police Sergeant Al Banatte told MargateNews.net.

*Banatte reported Wednesday that all dogs were up-to-date on vaccinations and all had proper paperwork.

The position of the Paradise Gardens I Homeowners Association was that the dog's shouldn't be living in an unoccupied dwelling without first consulting the HOA. This puts owners of the home, Parkland Whistler 001 LLC, in violation of HOA rules. The LLC purchased the home in 2012.

Christina Barletta calls herself a dog lover. Others call her a dog hoarder.  Barletta recently drew the attention of animal activists, police and neighbors when housing eight of her personal dogs in a vacant home in Margate.

Barletta was escorted by Margate police through the backdoor of 990 NW 67th Terrace Paradise Gardens Tuesday morning last week.  Nobody has lived at the residence for a year, yet the neighbors heard dogs barking in the home for days.

“I haven’t seen anyone move in,” neighbor Kenny across the street told MargateNews.net. “Why would dogs be there?”

Upon seeing that dogs were healthy and not abused, Margate police said they had no reason to remove canines from the home. Police learned that Barletta received permission from the homeowner to keep the dogs in the house for a short period of time while she settled into a new residence. The practicing nurse fell on hard times, Barletta told MargateNews.net, and the dogs needed a temporary home. A 55 and older community, the homeowners association (HOA) agreed to allow dogs to stay temporarily if Barletta moved in, the LPN told us.

While Barletta said the owner of the home did not want anyone in the house except her, she would bring a couple out for MargateNews.net to see.  

Canine brothers 'Jasper Jack' and 'Patrick Drake' - both 9-years-old, appeared friendly and lovable.

“They’re my personal dogs. Looking nice and healthy and fat as usual,” Barletta said. "They love you unconditionally.”

The subject of investigations by Palm Beach Animal Control for sub-standard treatment of pets, we Barletta how she’ll care for the dogs while in the Margate home.

“Like anyone who cares for their dogs. I go to work; I come home. I have friends that are helping walk them. I’m here when I’m not working or with my daughter,” Barletta said.

Animal Activists Tell a Different Story

Since publishing an article on the incident last week, numerous animal advocates have reached out to MargateNews.net with information alleging that Barletta is a known animal hoarder.

Darcy Butkus, aka “Inspector Bark,” said that while running an unlicensed non-profit organization called 'No Paws Left Behind Rescue', Barletta was “housing animals in deplorable conditions,” Butkus told MargateNews.net.

“She had to have her child removed from the home,” said the Georgia-based Private Investigator.

Butkus pointed to Palm Beach County Animal Control records from 2015 that showed Barletta with 31 dogs living in crates in a Boca Raton residence.  Police found dogs with urine and feces in cages and no water. Barletta told authorities that dogs were given water bowls sporadically so canines wouldn’t dump them over.

“The house had a very strong smell of ammonia which appeared to be from dog urine,” reported Animal Control Officer C. Cook. “After assessing the conditions of the home the decision was made to remove the resident’s 2-year-old daughter."

On a follow-up visit the next day, police said the urine odor remained and Barletta seemingly had people coming and going to adopt or foster dogs. At that point, police told Barletta she had 30 days to reduce the number of dogs in her home to 10.

According to documentation provided, Barletta was banned from adopting or fostering pets in Miami-Dade County in 2014. She since has traversed counties to the north.

“She moved to Broward to escape Palm Beach Animal Control. She is now being evicted specifically because she broke her lease again for having more than 18 dogs in inhumane conditions,” stated a correspondence sent to media and Margate City Commissioners.

In response to accusations of dog hoarding, Barletta told MargateNews.net that since falling on hard luck, she has been challenged with taking care of her pets and her daughter.

Despite past problems, she is working hard to get back on her feet.

Suspect Behavior by Rescue Group

Prior to MargateNews.net publishing “House Turned Dog Kennel” last week, dog rescue advocate, Amy Morgan, founder of the organization ‘100+ Abandoned Dogs of Everglades Florida Rescue,’ asked us to keep Barletta’s name from the press. At the time, the name Barletta was unknown to MargateNews.net; only that the pet owner was subject to personal problems, Morgan said.

The day following, Barletta told us she was not familiar with the 100+ organization until police questioned her. This, in contrast to a police officer handing a phone to Morgan during a live Internet broadcast (Seen in video below after 40-minute mark).

“Her name is Christina, she knows you and wants to speak with you,” police told Morgan.
“She’s calling you, the police?” Roman responded.

“Hello? Christina who? Okay. Wow,” Roman said over the phone in the broadcast.

Seconds later, the president of the Paradise Gardens I Homeowners Association (HOA) asked Morgan: “What’s going on?”

“Nothing,” Roman replied.

The HOA official responds: “Wait a minute. You won’t give us information?”

Roman got tight-lipped.

“Where’s the officer? I don’t want this on camera,” Roman said in the cyber-cast shared live with the rescue community.

As part of the broadcast, Morgan encouraged followers to “come out” and “start making phone calls.”

“Call Margate police; make a complaint. These animals need to be removed from this house. You can clearly see inside there is no food, no water. The neighbors have been watching day and night. Nobody has come back to this house. These dogs need to be removed immediately. They’ve been barking all night. They’re in clear distress,” she reported. “Start contacting the news stations guys on your own. You can do it.”

Prior to learning who owned the dogs, Morgan was highly critical of police and HOA officials for proceeding with caution. Police asked Morgan to wait patiently for law enforcement to contact the owner of the house and HOA officials asked her to stay off the property to allow police to do their job.

Police on scene told Roman there was no proof dogs were in distress. In response, Roman told police they had no proof dogs were not in distress. She emphasized a state statute that provides for police to enters where dogs are in distress.

Police: “Right now we don’t know what is going on, we’re trying to get a hold of the owner.”

Morgan: “We can’t prove otherwise that they are not in distress. You can see inside there’s empty bowls. No food no water. Right now they’re saying they can't do anything, which is BS. This is disgusting, there’s no protection. You call the authorities; you go through the proper channels, you call animal control...let’s see, let’s see what happens. I don’t even think they [police] know their own statute.”

Morgan’s opinion of the HOA president:

“Bitch,” said Roman. “She doesn’t care about animals. She’s here for her HOA. We don’t keep quiet when a dog is in danger. Especially six or seven, and she’s [HOA president] giving me the kennel license bullshit. I don’t care if she’s president of the association. We’re here to make sure that the dogs are taken care of.”

Inspector Bark Points to Sordid History of Organization

Referring to Roman and her organization as both ‘shamey’ and ‘shadey’, Butkus pointed to reports where ‘100+’ is under investigation by the Florida Department of Agriculture and Consumer Services for misappropriating funds, and for being the subject of high profile media reports. WSVN 7 reported in January that up to $100,000 or more of $650,000 in donations collected by Morgan may have been used for personal expenses.

“The state found 960 debit transactions, including $34,050.99 on food and restaurant expenses; purchases at Best Buy, Bed Bath & Beyond and Bath and Body Works; $10,097.74 to pay off a personal credit card; $6,876.83 for car payments and $4,705.40 on insurance premiums,” reported WSVN.   “The state says there was also a $30,000 loan from the rescue to buy a BMW registered to its president.”

While Butkus said she isn’t sure whether 100+ and Barletta are connected, the investigator has problems with the behavior of both.

“These are people who shouldn’t have dogs,” said Butkus, a self-proclaimed ‘whistleblower’ investigating rescue agencies for more than seven years.

Butkus has been sued by Morgan.

“Since I blew the whistle on her, she sued me," Butkus told MargateNews.net. "I am in an active lawsuit in Palm Beach County of which there was a hearing in February...My lawyers won the motion and the woman who is suing me has to pay for the cost of my lawyer’s time to prepare that motion.  This is the tactic and strategy these shady rescues take. They threaten with suing people,” said Butkus.

The 100+ plus organization is also connected to Margate City Commissioner, Lesa Peerman, who was violated by the Broward Inspector General (IG) in 2015 for not reporting $400 in donations she collected for the rescue organization at her wedding. (Click for IGfindings)

After receiving an email from mdvalcinmiami@gmail.com that positioned Barletta as a bad pet owner, two-term Commissioner, Lesa Peerman, reached out to fellow elected officials.

“If I can ask please do not response to this person,” Peerman requested of colleagues in an email. “The situation is more than what she is telling. I have been in contact with Palm Beach Animal Control.  She is trying to verify where these dogs are since the address was put on Margatenews.  Our police and animal control have seen the dogs and they are healthy and well taken care of.  The woman and dogs will be gone by Monday,” Peerman wrote.

Peerman has voted on land use laws in the City pertaining to the retail sale and residential keeping of dogs. Whether the situation with Barletta - or the organization 100+ will lead to further legislation discussed or enacted by elected officials will be seen.

Peerman told homeowners that elected officials agreed to remove the cap on the number of dogs a Margate household can keep.
